These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you”) and Mrs. Shar’s Famous Cookies, Inc. (“Company,” “we,” “our,” or “us”) regarding your access to and use of our website, products, services, and gift cards.

By purchasing, accessing, or using any product or service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services or purchase any products.

1. Company Rights & Modifications

We reserve the right to update, modify, suspend, or discontinue any part of our website, products, services, or policies at any time without prior notice.

Continued use of our services constitutes acceptance of any revised Terms.

2. E-Gift Cards

All e-gift card purchases are final sale and non-refundable.

Gift cards are not redeemable for cash except where required by applicable law and carry no expiration dates or maintenance fees.

Gift cards must be treated like cash. We are not responsible for lost, stolen, damaged, or unauthorized use of gift cards once issued.

Gift cards remain valid regardless of business model changes, including but not limited to relocation, closure of physical storefronts, or transition to online-only operations. Redemption will be honored through available fulfillment methods at the time of use.

3. Product Availability

Product availability is not guaranteed. Items may be prepared in advance or baked in batches and are subject to sell-out at any time.

We do not guarantee that any product displayed, advertised, or previously available will be in stock at the time of order or redemption.

4. Product Variation Disclaimer

Due to the handmade nature of our baked goods, variations in appearance, size, color, texture, or decoration may occur.

Such variations are normal and do not constitute defects. They are not grounds for refunds, credits, or exchanges.

5. Custom & Specialty Orders

All custom and specialty orders are final once confirmed, processed, or completed.

We do not offer refunds, credits, or exchanges based on taste, appearance, design interpretation, or customer preference.

Customers are responsible for reviewing all order details prior to final approval.

6. Refund Policy

All sales are final.

Due to the perishable nature of our products, we do not offer refunds, returns, or exchanges once an order has been prepared, processed, or delivered.

7. Fulfillment, Shipping & Business Operations

Mrs. Shar’s Famous Cookies, Inc. may operate as a physical storefront, online store, or hybrid model at any time.

We reserve the right to open, close, or relocate any physical location without notice.

In the event a storefront is not available, orders may be fulfilled through our online store and shipped where applicable.

Shipping availability, delivery timelines, and product selection may vary and are not guaranteed. We are not responsible for carrier delays, weather interruptions, or third-party shipping issues.

We do not guarantee that in-store products will be identical or available for shipping.

8. Fraud, Abuse & Order Cancellation

We reserve the right to refuse, cancel, or limit any order or Gift Card transaction suspected of fraud, abuse, or unauthorized activity.

We may request additional verification before processing certain transactions.

9. Chargebacks & Payment Disputes

By completing a purchase, you agree to first contact us directly to resolve any issue before initiating a chargeback or payment dispute.

We reserve the right to submit all order records, communications, and acceptance of Terms to financial institutions in the event of a dispute.

Unauthorized chargebacks may be treated as fraudulent activity where applicable.

10. Limitation of Liability

To the fullest extent permitted by law, Mrs. Shar’s Famous Cookies, Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our products, services, or website.

Our total liability shall not exceed the amount paid for the specific product or service in question.

11. No Warranties

All products and services are provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

12. Dispute Resolution

Any dispute arising from these Terms or use of our services shall first be attempted to be resolved informally by contacting us.

If unresolved, disputes shall be governed by the laws of the Commonwealth of Pennsylvania.

13. Entire Agreement

These Terms constitute the entire agreement between you and Mrs. Shar’s Famous Cookies, Inc. regarding use of our services and supersede any prior agreements or understandings.
